ECHA's recently published CMR report showed that companies are adhering well to the harmonised classification of substances with carcinogenic, mutagenic or reprotoxic (CMR) properties. The report also identified over a thousand other substances self-classified as CMRs by industry that potentially merit further regulatory action.

It defines a category of particularly dangerous chemical substances in their pure state, which alone or in mixtures can cause harmful effects to humans. The CMR chemicals here refer to the chemicals classified under the GHS as having carcinogenicity (category 1/1A/1B and 2), germ cell mutagenicity (category 1/1A/1B and 2) or reproductive toxicity (category 1/1A/1B, 2 and via lactation) . The comparison in this study is among chemicals with the same classification results, whether both are CMR chemicals or chemicals not classified as CMR (also known as “Not Classified” or NC). Substances meeting the criteria for classification as carcinogenic, mutagenic or toxic for reproduction category 1A or 1B in accordance with Commission Regulation (EC) No 1272/2008 (CMR substances) Substances which are persistent, bioaccumulative and toxic (PBT) or very persistent and very bioaccumulative (vPvB) according to REACH (Annex XIII) The report aims to (i) analyze the extent to which registrants/notifiers classified CMR substances in accordance with the harmonized classification included in Annex VI of the Classification, Labelling and Packaging (CLP) Regulation (EC) No 1272/2008(part A) and to (ii) identify which substances currently available on the EU market are classified for CMR properties by at least some notifiers/registrants but are lacking harmonized CMR classification (part B). A similar move away from CMR classified phthalates has occurred in North America, but in the rest of the world (China, India, Latin America) CMR classified phthalates including DEHP and DBP continue to be produced and used to a high degree. For CMR substances, although CHARM is highly evaluated for hazards, the risk is assessed to be low if exposure levels are assessed low. When evaluating the risk of highly hazardous chemicals such as CMR substances, we believe the model should be adapted to be more conservative and classify these as higher risk.

Under GHS, CMR substances can be classified into 3 categories depending on the severity of hazards. Category 1A: Known human carcinogen (H340), mutagen (H350) or reproductive toxicant (H360) based on human evidence ; Category 1B: Presumed human carcinogen (H340), mutagen (H350) or reproductive toxicant (H360) based on animal studies; Category 2: Suspected carcinogen (H341), mutagen (H351) or reproductive toxicant (H361) based on limited evidence from animal studies or/and human. Although there are several chemical classifications for regulating these substances and their use in terms of their CMR properties, only one of these classifications is included in a regulation. It is the Europeanclassification provided for under what is referred to as the CLP Regulation (for Classification, Labelling and Packaging). This Regulation, and thus the classification it contains, is directly applicable in all Member States of the European Union, including France.
